Judgement of the National Green Tribunal in the matter of Society for Preservation of Kasauli and its Environs (SPOKE) Vs Barog Heights Hotel dated 07/12/2017 regarding private buildings existing which are having more than 3 or 4 storeys and are running hotel business in Kasauli, Himachal Pradesh.

National Green Tribunal passes the following directions:

1. Hotel Barog Heights shall demolish the structure which is unauthorised and in exercise to the provisions of Himachal Pradesh Town & Country Planning Act, 1977.

Order of the National Green Tribunal in the matter of Devinder Sehrawat Vs. Hotel Jindal Palace & Others dated 29/11/2017 regarding hotels in Mahipalpur, Delhi operating without requisite permission. NGT directs NCT of Delhi and Delhi Pollution Control Committee to submit a report of the hotels that are operating in Mahipalpur.

Order of the National Green Tribunal (Eastern Zone Bench, Kolkata) in the matter of Subhas Datta Vs State of West Bengal & Others dated 22/11/207 regarding commercial establishments (hotels, lodges and restaurants) located in Buxa Tiger Reserve Forest Area.

Order of the National Green Tribunal (Central Zonal Bench, Bhopal) in the matter of Sheikh Sajid Vs. State of Madhya Pradesh & Others dated 09/11/2017 regarding waste management in hotels used for marriage functions. NGT, Central Zona Bench expressed satisfaction with the action taken by the hotels and ordered that "in case these sites are used by the respondents in a manner which requires any compliance under law and the same is not done, then the petitioner (Sheikh Sajid) would be free to raise the grievance accordingly".

Order of the National Green Tribunal in the matter of Pankaj Sharma Vs. MoEF & Others dated 26/10/2017 regarding restaurants in South Delhi running without obtaining environment clearance. Counsel appearing for Delhi Pollution Control Committee and the Corporation submit that they would ensure that no restaurants are permitted to carry out their operations or commercial activities unless they have obtained consent to operate from Delhi Pollution Control Committee and license from the Municipal Authorities.

Order of the National Green Tribunal (Eastern Zone Bench, Kolkata) in the matter of Sunil Mondal Vs West Bengal Pollution Control Board & Others dated 12/10/2017 regarding hotels in Burdwan town not complying with pollution norms.

NGT has asked for a list of non-compliant hotels along with the names of owners and their addresses to be submitted before the next date of hearing and also directed the State PCB to inspect all the hotels in Burdwan town and submit a report on the compliance of the pollution norms without fail before the next date.

Order of the National Green Tribunal in the matter of Society for Preservation of Kasauli and its Environs (SPOKE) Vs. Barog Heights Hotel dated 04/10/2017 regarding illegal construction in the hill town of Kasauli in Himachal Pradesh. The case relates to the 1.5 km long road from the highway to the Barog Hotel. The counsel appearing for the State of Himachal Pradesh submits that the records of this case are not available with any Department of the State Government and no inquiry etc. was pending with them. The matter is listed for 05/10/2017.

Goa State Pollution Control Board & Others dated 22/09/2017 regarding consent to operate granted to Linet Nunes Curlies Restaurant, Panaji, Goa. Tribunal directs Linnet Nunes to submit to the Pollution Control Board the NOC/approval from the concerned Panchayat.
