Judgement of the National Green Tribunal (Western Zone Bench, Pune) in the matter of Kashinath Jairam Shetye & Others Vs Jaiprakash A. Shirsaikar & Others dated 02/05/2017 regarding illegal structures in property bearing Survey Nos. 213/23-A of village Anjuna Bardez, Goa.

GCZMA had directed Eliano Pereira to demolish illegal cottages/structures and restore the land to its original condition vide order of 25th August, 2015 which he failed to comply. Failure on the part of Eliano Pereira to demolish cottages/structures, the Deputy Collector and SDM Mapusa-Bardez, Goa was to remove the said cottages/structures and recover expenses incurred for from him.

NGT finds that the Respondent Eliano Pereira misled the Tribunal by the compliance report that stated that the illegal structures and cottages were demolished. NGT directs that Eliano Pereira to be prosecuted for the commission of offence punishable under Section 193 of the Indian Penal Code, 1860.
