Order of the National Green Tribunal in the matter of Ankur Kashyap Vs. State of Uttar Pradesh & Others dated 16/04/2018 regarding illegal in the state of Uttar Pradesh. The Applicant (Ankur Kashyap) states that the State of Uttar Pradesh is unjustifiably procrastinating this proceeding allowing illegal mining to continue. He submits that unchecked illegal mining is going on and no action is being taken by the State.

NGT directs the State of Uttar Pradesh to secure factual information regarding legal or illegal mining in the jurisdiction of each Deputy Commissioner/District Magistrate who shall submit report within two weeks. They may also indicate in the report as to whether those persons who are engaged in the permissible mining are adhering to the sustainable mining guidelines of 2016 issued in this regard. In the meanwhile, if there is any illegal mining going on, the State shall ensure its stoppage forthwith and report in this regard be also filed.
