Order of the National Green Tribunal in the matter of Arjunan Muthukrishnan Vs The State Environment Impact Assessment Authority & Others dated 21/01/2019 regarding violation of environment laws by M/s. Jain Housing. A report filed by the Tamil Nadu Pollution Control Board (TNPCB) submits that the unit is said to be violating the provisions of the Water (Prevention and Control of Pollution) Act, 1974, the Air (Prevention and Control of Pollution) Act, 1981 as well as the Environment (Protection) Act, 1986 for which action has been initiated but, has not been finalized. NGT finds no reason why the issue is being kept pending when the Board is satisfied about violations.

NGT directs TNPCB to take appropriate action, including recovering compensation for the damage to the environment for violation of the statutory provisions, apart from initiating prosecution and taking other actions in terms of Section 33B of the Water (Prevention and Control of Pollution) Act, 1974 and Section 31A of the Air (Prevention and Control of Pollution) Act, 1981. The TNPCB may also consider removing any illegal construction as may be found.
