The matter related to discharge of untreated water from Dwarkadham Colony into the open land causing health hazards to nearby residence and construction by Dwarkadheesh Haveli Builders without any requisite approval from the Competent Authority in addition to the violation of The Air (Prevention and Control of Pollution) Act, 19 and The Water (Prevention and Control of Pollution) Act, 1974 has been raised in this application.

The NGT directed Madhya Pradesh Pollution Control Board to recover environmental compensation from the project proponent (Dwarkadheesh Haveli Builders). Collector, Bhopal and Municipal Corporation, Bhopal has been directed to take necessary action so that the parameters which have been laid down for environmental laws must be complied with and necessary action must be initiated and taken without any delay subject to cost to be recovered from the project proponent.
