Order of the National Green Tribunal in the matter of Jagdish Kumar Vs State of Haryana dated 16/01/2023.

The matter related to compliance of Solid Waste Management Rules, 2016 in the state of Haryana.

The court noted that the matter was dealt by the NGT in the last five years by several orders, last order being May 9, 2022 on consideration of status report filed by the Chief Secretary, Haryana dated April 29, 2022.

The Tribunal noted that the status report did not give complete picture about the compliance status of solid waste management. Accordingly, the court required further report about compliance status with all the details and destination of the material required from the legacy waste sites. in compliance, a report was filed by the ACS, Urban Local Bodies, Haryana, January 13, 2023.

After going through the report, the NGT found that there is still gap in generation and processing of fresh waste, apart from the processing of legacy waste as per the Solid Waste Management Rules, 2016. A similar case is to be heard in the court on February 9, 2023 and till then the court directed that the state authorities take further remedial measures to ensure that there is no gap in generation and processing of waste and legacy waste remediation.
