Order of the National Green Tribunal (Central Zone Bench, Bhopal) in the matter of Faraz Azam Vs State of Madhya Pradesh & Others dated 02/05/2023.

The grievance of the applicant is that the project proponent, Lake Courtyard Heights undertaking construction activities within 50 meters distance from the Upper Lake.   Construction and development within the no construction zone adversely affects the water quality and this, if not prevented, gives rise to issues such as sedimentation, urban storm water runoff, pollution of water systems and harm to the aquatic environment said the complainant, Faraz Azam.

The contention of the applicant was that the report submitted by the Mukhya Nagar Niweshak, Nagar Palika Nigam, Bhopal communicated vide order dated October 26, 2021 had sought a clarification with respect to the full tank level (FTL) and without clarifying it, the authorities permitted the construction activities by Lake Courtyard Heights. This is also in violation of Wetland (Conservation and Management) Rules, 2017.

The NGT directed submission of a report from a joint committee on the matter. The committee has been directed to visit the place and submit the factual and action taken report within six weeks.
