Order of the National Green Tribunal in the matter of Devidas Khatri Vs Union of India & Others dated 10/07/2023.

The joint committee report of February 23, 2023 was filed in compliance with the National Green Tribunal order dated August 1, 2022 related to mining and sand washing plants in Shankargarh Block, Prayagraj district.

Counsel appearing for the UPPCB informed the court that necessary steps were being taken against the violators. The report said that there are 7 leases for active mining out of 25 mining leases granted (18 leases have already expired). In addition, there are 42 silica sand washing plants. The report has indicated several violations with respect to mining and sand washing plants.

However, the report has not elaborated on the restoration of mined areas, overall compliance with CTO conditions, the extent of damages observed and other aspects noted the NGT.

The court directed the UPPCB to further file report on the observations, identify all violators and action taken for past violations and restoration of the area.
