Order of the National Green Tribunal (Southern Zone Bench, Chennai) in the matter of Radhakrishnan K.U Vs Union of India & Others dated 21/09/2017 regarding Environment Clearance (EC) and CRZ Clearance granted to Indian Oil Corporation Ltd., (IOC) for LPG Import Terminal at Puthuvypeen SEZ (Cochin Port Trust, Cochin) by MoEF & CC. NGT while dismissing the Application quoted cases where it was necessary to protect the project proponent from the delayed litigation when certain investments have been made by the project proponent and substantial development might have been done. NGT also condoned the delay in filing the Application as it was beyond the condonable limit of 60 days which is not within the jurisdiction of this Tribunal.
