Compliance of National Green Tribunal in the matter of O.A. No. 716/2019 in the matter of Ajay Kumar Vs State of Uttar Pradesh & Others dated 30/12/2019. The matter relates to air pollution by emission of coal dust and cement dust by operation of JP Cement factory and its power plant at Churk, District Sonbhadra, Uttar Pradesh.

The NGT in its order of September 18, 2019 directed the District Magistrate, Sonbhadra and the State Pollution Control Board to jointly look into the matter and take appropriate action in accordance with law and furnish a factual and action taken report in the matter. In this context, the unit was inspected by a joint team of district administration and Uttar Pradesh Pollution Contol Board and shortcomings in air pollution control system were observed. Show cause notice was issued to the unit on November 29, 2019 and environmental compensation of Rs. 92.10 lac was imposed. Industry submitted a compliance report to reconsider the compensation imposed, as the unit was now complying with the environmental laws.
