Order of the National Green Tribunal regarding violation of environmental norms by SSF Polymers, Bahadurgarh, district Jhajjar, Haryana, 25/06/2020 [1]

Order of the National Green Tribunal in the matter of HL City Resident Welfare Association Vs State of Haryana & Others dated 25/06/2020.

Grievance in this application is against violation of environmental norms by M/s SSF Polymers Pvt. Ltd., Nuna Majra, Sector 37, Bahadurgarh, District Jhajjar. According to the applicant, location of the said industrial unit near the residential area would affect the health of the inhabitants on account of discharge of toxic gases by it.

The unit has been allowed to continue by Divisional Commissioner on a 'specious observation' that there is no parameter to assess the pollution potential. The applicant has annexed photographs showing polluting emissions from the unit. In view of above, before further consideration, we consider it appropriate to first require a factual site visit based report.

The NGT directed the constitution of a joint Committee comprising of Central Pollution Control Board (CPCB) and Haryana State Pollution Control Board to visit the site and ascertain the pollution potential and desirability of location and continuation of the unit having regard to the impact on the environment and public health. The report has to be filed within two months. The court said that the viewpoint of the industrial unit should also be taken into account by the Committee and report placed on the CPCB website for response of the unit, if any.
