Order of the National Green Tribunal in the matter of Balkrishan Vyas Vs State of Rajasthan dated 01/07/2021.

The issue for consideration is the remedial action against illegal blasting and mining by M/s Jindal Saw Ltd., Bhilwada, Rajasthan resulting in damage to a number of houses in the vicinity. The houses have developed cracks on the walls and leakage of water is taking place from the underground water tanks of some houses.

The Rajasthan State Pollution Control Board in its report to the NGT, August 19, 2019 annexed a report from the Geological Survey of India - which said that 375 buildings had cracks which were attributable to local vibrations and shaking.

The NGT directed that a compensation of Rs. 1 lakh for each of the 375 affected persons must be given and M/s Jindal Saw Ltd., Bhilwada has been directed to deposit a sum of Rs. 4 crores with the District Magistrate, Bhilwada within one month to enable compensation to be disbursed to the victims and for restoration of the environment. Jindal Saw has been asked to take precautions in future and undertake scientific blasting, which does not cause any damage to the property of the inhabitants and this would be treated as a condition for mining and using blasting.
