Order of the National Green Tribunal in the matter of Chaitanya Bhandari & Others Vs Uttarakhand Environment Protection & Pollution Control Board dated 11/11/2021.

Grievance in the application is against failure to scientifically manage the dumping ground at Gairsain, district Chamoli, Uttarakhand, for disposal of waste, in violation of Solid Waste Management Rules, 2016 (SWM Rules, 2016).

The NGT directed that legacy waste accumulated at the site needs to be remediated, waste processing plant needs to be set up and operationalized for day to day management. To ascertain waste management for towns having population of less than one lakh in the state, the Uttarakhand Pollution Control Board has been directed to take further remedial action and submit a report.
