Order of the National Green Tribunal in the matter of Manoj Markendeyrao Wahane Vs Maharashtra Bamboo Development Board & Others dated 19/09/2022.

The Maharashtra Bamboo Development Board had set up a chemical treatment plant for bamboo processing within the Gorewada reserve forest, Nagpur, Maharashtra without forest clearance. Thus, the board had violated Section 2 of Forest Conservation Act by not taking permission from the Central Government for use of any part of the land which was given to them for the purpose of plantation for research purpose, the judgment of the NGT, September 19 said.

The NGT directed the Maharashtra Pollution Control Board to make calculation of compensation amount in accordance with rules and proceed to realize the same within a period of 2 months after giving the opportunity of hearing to Maharashtra Bamboo Development Board and ensuring that the said place is restored to its original condition.
