Order of the National Green Tribunal in the matter of Rita Sharma & Others Vs State of Himachal Pradesh & Others dated 21/07/2023.

The matter related to dumping of waste in village Dughneri, district Hamirpur.

The Principal Secretary, Urban Development, Himachal Pradesh informed the court that legacy waste tender agreement has been done by the Municipal Council, Hamirpur with Suntan Life Company and legacy waste process work has been started by the company at SWM plant, Dughneri. 3121.54 ton legacy waste has been sorted till July 2, 2023.

The Principal Secretary said the quantity of legacy waste was more than the estimated 2100 tons and assured that the work will be finished in a time bound manner in at least nine months. The court directed the forest department that the forest land shall not be encroached by illegal means or to be used for dumping purposes. The authorities were directed to take further remedial actions and ensure disposal of legacy waste within the timeframe and submit an action taken report after three months.

The NGT directed the authorities to ensure timely disposal of legacy waste dumped in village Dughneri, district Hamirpur and submit an action taken report. The court, July 21, 2023 also directed the forest department that the forest land shall not be encroached by illegal means or to be used for dumping purposes.
