Order of the National Green Tribunal in the matter of Hussain Ahamad Vs State of Uttar Pradesh & Others dated 13/10/2023.

According to the applicant, brick kiln owners in an area in Muzaffarnagar district have done illegal mining of earth from the nearby agricultural fields by digging pits upto 15-20 feet and thereafter, the pits were abandoned. Those, abandoned pits got filled up during the rainfall and 5 children had died, who had accidently entered the pits filled with the rain water and mud.

The court was of the view that a substantial issue relating to the environment was involved in the matter and directed the constitution of a three member committee. The committee will visit the site and find out the factual position and also suggest remedial measures. The report has to be submitted before the next date of hearing, January 5, 2024.
