Order of the National Green Tribunal (Eastern Zone Bench, Kolikata) in the matter of Takam Xavier Vs Union of India & Others dated 25/01/2018 regarding primary metallurgical industries requiring Environmental Clearance (EC).
NGT took a stern view of the "recalcitrant and truant" attitude of the State of Arunachal Pradesh. The Court noted that the primary responsibility to furnish information on the various allegations pertaining to the incorporation and the category of the industries lies with the Directorate of Commerce & Industries, Govt. of Arunachal Pradesh. Unfortunately, the Director of Industries has not been impleaded as a respondent but notwithstanding that, the State of Arunachal Pradesh has been impleaded and therefore, ought to have responded to the notice issued upon them promptly.
