Order of the National Green Tribunal (Eastern Zone Bench, Kolkata) in the matter of Sushovan Saw Vs MoEF& Others dated 05/01/2024.

The National Green Tribunal (NGT), October 19, 2022 said that whether Taradi-Dhabra Shashikhal Motar Marg above the Naula of village Malla Dhadhariya requires environmental clearance (EC) in view of EIA Notification 2006 needs to be looked into by the authorities.

The Ministry of Environment, Forest and Climate Change (MoEFCC) on October 11, 2022 has issued Draft amendment to Notification No. S.O. 1533 (E), dated the September 14, 2006 which specifies “Prior environmental clearance required certain activities”.

Several projects in coastal regulation zones were approved during the 2015-2020 period despite inadequacies in the environmental impact assessment (EIA) reports, according to this CAG report tabled in Parliament on 8th August, 2022.

Judgment of the National Green Tribunal in the matter of Praveen Kakar & Others Vs Ministry of Environment, Forest and Climate Change & Others dated 04/07/2022.

Three applicants (Praveen Kakar, J C Kalra and D K Pant) filed an application before the NGT regarding M/s. Ansal Properties and Infrastructure Ltd. alleged encroachment and sale of a substantial part of land - comprising about 45% of the construction project, meant for parks and roads in Sushant Lok, Phase I, Gurgaon. This was in violation of  environmental laws, causing degradation to the environment.

Order of the National Green Tribunal in the matter of Dileep Singh Vs State of Uttar Pradesh & Others dated 01/07/2022.

The applicant has filed the present application seeking setting aside/quashing of the impugned Environmental Clearance, March 31, 2018 issued in respect of sand ghat/ mine located at khand No. 11/15 and 11/16 at village Diya Upahar, tehsil, Manjhanpur, district Kaushambi, Uttar Pradesh for an area measuring 24.28 hectares.

Judgment of the National Green Tribunal in the matter of P. Sundaravathanam Vs Union of India & Others dated 31/05/2022.

The matter related to grant of Environmental Clearance (EC) in favour of M/s. NLC India Limited for their second expansion of the thermal power plant having a capacity of 2 x 660 MW Super Critical Lignite-based Plant by the Ministry of Environment, Forests & Climate Change (MoEF&CC). The appellant has alleged that there was no proper environmental impact assessment conducted as well as no cumulative impact assessment was conducted for this project.

Joint Committee report in reference to the National Green Tribunal in the matter of the Original Application No. 327/2021 (Rajjan Vs State of Uttar Pradesh & Others).

Grievance in the application is that cluster EIA procedure was required to be followed before grant of EC for sand mining, village Adhawaal, tehsil Fatehpur, district Fatehpur - having regard to the location of the sites, for which impugned EC has been granted in favour of Limelight Dealers Pvt. Ltd., M/s Pragyasan Business Pvt. Ltd., M/s Alok Mishra and M/s Anantadrishti Multiventures LLP.

Report of the Joint Committee in the matter of Tumkunta Narsa Reddy Vs Union of India & Others. 

The applicant, Tumkunta Narsa Reddy, filed an application before the NGT on the commencement of the construction of Industrial Park by R4 (TSIIC) in an extent of 972.05 acres in Wargal and 374.06 acres in Mulugu, Siddipet district, without obtaining Environmental Clearance as required under EIA Notification, 2006.
