Order of the National Green Tribunal regarding storage of inflammable chemicals at village Rithala, Delhi, 09/08/2019 [1]

Order of the National Green Tribunal in the matter of Urmila Vs Govt. of NCT of Delhi dated 09/08/2019 regarding storage of inflammable chemicals at Rana Complex, Village Rithala, Rohini, Delhi, which has potential of impacting public health in violation of the “Manufacture, Storage and Import of Hazardous Chemical Rules, 1989 (1989 Rules) under the Environment (Protection) Act, 1986 and the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016.

The report furnished by Delhi Pollution Control Committee (DPCC) confirmed that different chemicals were found stored for distribution to customers including titanium dioxide, plastic colours, CPE (Chlorinated Polyethylene Resin), oxidising Polyethylene, PVC Stabilized etc. The report further stated that "solid waste management were found very poor and loose empty bags containing powder of the said chemical besides residual chemical after washing of hand & mouth of the labour, bathing found in the adjoining as well as opposite empty plots.”

Through order of March 1, 2019 the Tribunal directed the DPCC to furnish a further action taken report on the subject of onsite and offsite emergency plans by the occupiers. Accordingly, the report was filed on August 7, 2019 by the DPCC stating that compensation for damages have been collected, supply of electricity and water have been disconnected and the units have been closed.
