Order of the National Green Tribunal in the matter of Chandni Chemicals Pvt. Ltd. Vs Uttar Pradesh Pollution Control Board & Others dated 28/01/2020 regarding orders of the Uttar Pradesh State Pollution Control Board assessing compensation on 'polluter pays' principle for violation of law. According to the applicants, their units were not in operation at the relevant time and did not dump the hazardous waste for which they are held liable.
NGT directs that the UPPCB orders should be treated as a proposal with reference to which the applicants can furnish their response. Furtherance to it, the UPPCB would consider the objections of the applicants and pass an appropriate order within four weeks.
