The Ministry of Electronics and Information Technology and the Ministry of Information and Broadcasting on 25.02.2021, notified the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. In respect to the Over-the-top (OTT) platforms or curated content, the Government in its press release has expressed the view that there have been widespread concerns about issues relating to digital contents both on digital media and OTT platforms or certification. A number of Public Interest Litigation as well as other cases against OTT platforms were also filed in various high courts and before the Supreme Court of India, calling for regulation of content that was being aired through the OTT platforms.
