Order of the National Green Tribunal in the matter of Tanaji Balasaheb Gambhire Vs Union of India & Others dated 09/06/2021.

Grievance in the application is against location of a building project developed by M/s XRBIA North Hinjewadi Developers Private Limited, Pune, in prohibited area of blue flood line of Pawana river and also in violation of conditions of Environmental Clearance (EC), March 31, 2015 and conditions of Consent to Operate, February 4, 2020 under the Water Act, 1974 and Air Act, 1981. There is also allegation of violations of Solid Waste Management Rules, 2016.

The court said that since the case involved a substantial question of environment, a joint committee of the Central Pollution Control Board (CPCB), State Level Environment Impact Assessment Authority (SEIAA), Maharashtra, Maharashtra Pollution Control Board and District Magistrate, Pune should look into the matter and give its report.
