Order of the National Green Tribunal in the matter of Gauri Maulekhi Vs Union of India & Others dated 16/02/2022.

The matter dealt with the validity of the EC granted by the MoEF&CC for development of modern poultry and egg market with a built up area of 96,629.057 sqm, adjacent to NH-24 Ghazipur, New Delhi by M/s Delhi Agricultural Marketing Board (DAMB).

The present application seeks compliance of the NGT order, May 19, 2021 (Appeal No. 11/2021, Gauri Maulekhi v. MoEF&CC & Others).

The NGT, May 19, 2021 observed that no Environment Impact Assessment (EIA) had been conducted with regard to the slaughtering activities and had directed that the EC should not be given till an appropriate EIA is conducted.

In the present application, grievance is that despite the NGT order, no EIA has been conducted and the project proponent is proceeding with the construction illegally. In the absence of EC no construction can take place and if such construction is allowed, irreversible consequences would follow, warned the NGT, February 16, 2022.
