Order of the National Green Tribunal in the matter of Jayant Kumar Vs Ministry of Environment, Forest and Climate Change & Others dated 07/12/2022.

The Ministry of Environment, Forest and Climate Change (MoEF&CC) was directed by the National Green Tribunal (NGT), December 7, 2022 to collect information regarding mining leases in which environmental clearance was granted by the District Environment Impact Assessment Authority (DEIAA) and the period of which has not yet expired.

The information has to be collected from all the states and Union Territories. The MoEF&CC should issue appropriate directions for compliance with direction given the Supreme Court (Deepak Kumar Vs. State of Haryana & Ors, 2012) and NGT order dated September 13, 2018 (Satendra Pandey Vs. MoEF&CC & Anr) by re-appraisal for grant of Environmental Clearance by the State Environment Impact Assessment Authority (SEIAA). Action taken report in this regard should be filed by MoEF&CC before the NGT within two months.
