Judgement of the Supreme Court of India regarding demolition of twin 40 storey towers of Supertech, Noida, Uttar Pradesh, 31/08/2021 [1]

Judgement of the Supreme Court of India in the matter of Supertech Limited Vs Emerald Court Owner Resident Welfare Association & Others dated 31/08/2021.

The Supreme Court directed the demolition of twin 40 storey towers (Apex and Ceyane) in the Emerald Court project of Supertech Ltd in Noida for violation of building norms. The work of demolition should be carried out within a period of three months and must be carried out by Supertech Limited at its own cost under the supervision of the officials of NOIDA.

Further, in order to ensure that the work of demolition is carried out in a safe manner, the authorities have been asked to consult its own experts and experts from Central Building Research Institute, Roorkee. The apex court, August 31, 2021 upheld the order of the Allahabad High Court directing the demolition of the two 40 floor towers in Supertech's Emerald Court in Noida.

The SC noted that the case was replete with "instances which highlight the collusion between the officers of NOIDA with the appellant and its management. The case has revealed a nefarious complicity of the planning authority in the violation by the developer of the provisions of law."
