The applicant has raised a grievance that unauthorized and illegal construction of houses, shops and other commercial establishments on a large scale are in progress in Greater Noida and Noida in violation of environmental norms. Since many of these illegal construction is being done with top soil, the act is causing large scale illegal mining of top soil in and around the villages, resulting in deep, catastrophic pits which is giving rise to a vicious cycle.

The bench of Justice Surya Kant and Justice Dipankar Datta directed that the waterbodies in Greater Noida should be restored along with the catchment area. Counsel for Greater Noida and senior AAG for Uttar Pradesh assured to submit the restoration plan within four weeks.

Grievance raised by the applicants is that there is illegal extraction of ground water by the builders operating in Noida According to the applicants, the authorities have failed to prevent illegal extraction of ground water for commercial purposes resulting in depletion of ground water level in the area identified as ‘overexploited’ as per assessment of the Central Ground Water Authority (CGWA).

The NGT directed Express Builders and Promoters Private Limited to pay Rs. 15 crores for illegal constructions undertaken in 'Express Zenith', sector 77, Noida, Uttar Pradesh.

The applicant (Vineet Sinha) said that the project proponent has exceeded the limit of construction with the connivance of the Noida Authority and failed to set up pollution control devices as required.

Gaur Atulyam Apartment Owners Association filed an application in the NGT under Section 14 of the National Green Tribunal Act, 2010 regarding construction of mobile towers in green belts including green belt in front of Gaur Atulyam Society, Greater Nodia.

Submissions on behalf of the applicant (Vineet Sinha) to the joint inspection report, February 19, 2022 submitted by the UPPCB, CPCB and SEIAA and report dated May 2, 2022 submitted by NOIDA. The matter related to the complaint that Express Builders and Promoters Private Limited does not possess a prior Environment Clearance as mandated under Clause 2 of EIA Notification, 2006 and the entire housing project 'Express Zenith, Plot No. GH-02A, Sector-77, Noida has been constructed and developed without an Environment Clearance.

Order of the National Green Tribunal in the matter of Mahakar Singh Vs State of Uttar Pradesh dated 06/01/2022. Issue for consideration is the remedial action against illegal cutting of trees, extraction of groundwater and construction without Environmental Clearance (EC) for the project of Wave City at Ghaziabad and High-Tech City at NOIDA by the project proponent (PP) M/s Uppal Chadha Hi Tech Developers Pvt. Ltd.

The matter was considered by the NGT in the last two years and the court had passed orders with respect to it.
