The Supreme Court, July 21, 2021 had directed those states who have not been able to achieve the target for registration of the unorganised workers to do so and cooperate with the Ministry of Labour and Employment and to ensure to it that those unorganised labourers and workers in different sectors are registered in the eShram portal. Further, the states and Union Territories were directed to submit the report to the Ministry of Labour and Employment on completion of six weeks so that the "Union of India can file a further status report".

The SC noted that the affidavit filed by the government of India showed that many of the states have yet to achieve the target while some states have done very well. The SC directed that a fresh chart as on December 6, 2022 be given on the number of migrants registered against the target. The case has been listed for December 15, 2022.
