Order of the Supreme Court regarding grant of EC to a mining company in village Musnota, tehsil Narnaul, district Mahendragarh, Haryana, 28/08/2023 [1]

Order of the Supreme Court of India in the matter of Sunder Singh & Others Vs M/S Satish Kumar Garg and Company & Others dated 28/08/2023.

The Supreme Court, August 28, 2023 directed that till further orders are passed trees should not be cut by the mining company, M/S Satish Kumar Garg and Company on the strength of the environmental clearance by the State Expert Appraisal Committee (SEIAA) granted on August 8, 2023.

The matter related to environmental clearance given to a proposed mine (79.32 hectare) for exracting quartz, feldspar, barites, quartzite and stone, village Musnota, tehsil Narnaul, district Mahendragarh, Haryana.

The counsel for the petitioner said that if the trees in the concerned area are cut down, nobody can undo the felling of the trees and the condition subject to the outcome of the case, would be meaningless. The counsel pointed out that if mining is to be undertaken, the axe will fall on around 46,226 trees. The counsel also said that the proposed mining area is within the Aravali Plantation Hills and being a protected area, mining cannot be allowed there.
