Judgment of the National Green Tribunal (Western Zone Bench, Pune) in the matter of Navi Mumbai Environment Preservation Society Vs . City and Industrial Development Corporation Of Maharashtra (CIDCO) dated 11/10/2023.

The applicants have requested CIDCO to be restrained permanently from selling, transferring or granting any leasehold rights on the CRZ-I and CRZ-II affected areas of plot no 2A, Sector 54, 56 and 58 in Nerul (West), Navi Mumbai for the purposes of construction of residential and commercial buildings/structures. CIDCO, is a special planning authority for Navi Mumbai under the Maharashtra Regional and Town Planning Act, 1966 and leases various plots of lands which are under ownership and control for development purposes in Navi Mumbai. The plot number in question falls in CRZ-I and CRZ-II as per CRZ Notification, 2011.

NGT directed that CIDCO should not sell, transfer or grant any leasehold rights in plot no.2A, sectors 54, 56 and 58 of Nerul (West), Navi Mumbai for the purposes of construction of residential and commercial buildings/structures except the area falling outside CRZ.
