On February 09, 2021, the Government of India vide the Ministry of Commerce and Industry published the draft Patents (Amendment) Rules, 2021 (hereinafter referred to as the “new draft Rules”) as a proposal to further amend the Patents Rules, 2003. The new draft Rules are open for feedback for a period of thirty days, after expiry of which will be taken into consideration. The new draft Rules include a new category of applicant i.e. “eligible educational institution” in addition to natural person(s), start up(s), and small entity(ies).
