Order of the National Green Tribunal in the matter of Mani Shankar Dubey Vs State of Uttar Pradesh & Others dated 10/11/2020.
Grievance in this application is that illegal mining is being done by Shesh Narayan Karwariya at Khand No. 16/16 & 16/17, village Jamunapur, tehsil Manjhanpur, district Kaushambi, Uttar Pradesh. The applicant, Mani Shankar Dubey said that the mining lease was given January 4, 2020. Environmental Clearance was granted on May 23, 2019.
The area was submerged under water and during this time mining is not permissible as per conditions of EC. The case of the applicant is that mining took place when the area was submerged under water.
The NGT said that the grievance needs to be looked into by the concerned statutory authorities - the Uttar Pradesh Pollution Control Board (UPPCB), the District Magistrate, Kaushambi and the District Mining Officer, Kaushambi. The UPPCB would be the nodal agency for coordination and compliance. After looking into the matter, further remedial action must be taken, the court said and a report submitted within three months.
