Order of the National Green Tribunal regarding a CBWTF facility, Sanwer Road Industrial Area, Indore, Madhya Pradesh, 05/04/2022
Order of the National Green Tribunal (Central Zone Bench, Bhopal) in the matter of Puneet Jain Vs Madhya Pradesh State Environment Impact Assessment Authority (SEIAA) dated 05/04/2022.
The application was filed in the NGT, challenging the order passed by the Madhya Pradesh State Environment Assessment Authority (MPSEIAA), January 27, 2021 - whereby environmental clearance was accorded for a Common Bio-Medical Waste Treatment Facility (CBWTF), Sanwer Road Industrial Area, Indore.
The CPCB has submitted that all steps are taken for proper disposal of the waste generated through the hospitals and that CBWTF is intended to "achieve the target of disposal of all waste materials generated from the hospitals within a specified area and it does not prohibit establishment of any other facility in accordance with the gap of generation and disposal capacity."
There is no illegality in the MPSEIAA order and is in accordance with law and within the jurisdiction. Nothing was shown to be in contravention of any provisions of Bio Medical Management Rules or the guidelines issued by the CPCB and the appeal has no merit, the NGT order said and dismissed the case.
