Order of the National Green Tribunal in the matter of Noorul Sehar Lari Vs State of Uttar Pradesh & Others dated 15/09/2023.
Grievance raised in the original application is against discharge of untreated sewage of the municipal council Lar, district Deoria, Uttar Pradesh in open land (khasra no. 1712 in an area of 0.1980 hectares).
The Tribunal had earlier directed the constitution of the Joint Inspection Committee and had noted the violations and finally by the order dated February 9, 2023 had given opportunity to the concerned authorities to comply with the earlier directions by making it clear that if failure continues, stringent coercive measures would have to be adopted. A fresh report was filed mentioning that all the relevant directions had been complied with.
The NGT, September 15, 2023 suggested to the Principal Secretary, Urban Development, Uttar Pradesh to explore the possibility of setting up four waste stabilization ponds instead of existing two ponds. It is also noticed that in the report parameters of fecal coliform though within the limits but are on the higher range, therefore, it is required to be controlled. Hence these two issues require further consideration at the end of the Lar Nagar Panchayat, the order said.
The National Green Tribunal (NGT) directed Nagar Panchayat Lar to carry out the samples analysis after three months especially in respect of compliance to fecal coliform norms and operationalization of sewage treatment system and submit a report before the Registrar General of the NGT by December 22, 2023.
