Order of the National Green Tribunal regarding illegal construction and illegal extraction of groundwater without permission, Ghaziabad, Uttar Pradesh, 13/04/2021
Order of the National Green Tribunal in the matter of Shailesh Singh Vs M/s. Aadi Best Consortium Pvt. Ltd. dated 13/04/2021. This application was filed on August 27, 2015 for remedial action against illegal construction without permission of the Ghaziabad Development Authority (GDA) and also extraction of groundwater without permission of the Central Ground Water Authority (CGWA).
On September 2, 2015 notice was issued to the contesting parties who filed their replies. Vide order April 9, 2016, the Tribunal noted that M/s. Aadi Best Consortium Pvt. Ltd. has admitted to illegal extraction of water but stated that it was for consumption by the workers at the site and not for construction.
On August 1, the matter was heard and judgement was reserved. However, the judgement was never delivered and the members, who heard the matter have retired without either party taking any further step. The matter has been listed for the first time today in view of administrative order.
The NGT, April 13, 2021 noted that that stand of Aadi Best Consortium on the issue of illegal constructions as well as illegal extraction of ground water was evasive and they were not able to explain as to how against sanction of 16 floors, 26 storeys were constructed. The NGT directed a seven-member joint Committee of Secretary, Urban Development, CPCB, CGWA, Uttar Pradesh Pollution Control Board, Ghaziabad Nagar Nigam, GDA and District Magistrate, Ghaziabad to hold a joint meeting to look into the issue of legality of construction and extraction of groundwater and decide on further remedial action.
