Order of the National Green Tribunal regarding illegal transporting of mined materials through forest of Ghoghor, Bharatpur District, Rajasthan, 29/08/2019
Order of the National Green Tribunal in the matter of Hafiz & Others Vs Union of India & Others dated 29/08/2019 regarding Enkasa Mines and Minerals Pvt. Ltd., engaged in the illegal transporting of mined materials through forest of Ghoghor, Bharatpur District, Rajasthan. The application states that the miners have illegally laid a road in the forest land regarding which several complaints were lodged with the Forest Department. The laying of the road without permission from the competent authorities like the forest department, itself requires order of restrain for using of road. Further, the road which was originally constructed for village panchayat and meant to be used only by villagers and forest department have been illegally encroached by the miners.
The Chief Conservator of Forest, Bharatpur informed NGT that even though they had removed the encroachment and diversion of the road but they are finding it diffcult to take further action "in view of lack of sufficient manpower and unmatched illegal force" of the miners.
The Tribunal directs the District Magistrate, the Conservator of Forest and police to assist the forest department officials in removing the illegal encroachment wherever it is done and a compliance report filed within four weeks.
