Order of the National Green Tribunal in the matter of Yogendra Mohan Sengupta Vs Union of India & Others dated 31/08/2021.

Applications were filed before the NGT for directions to permit the project of multi-level parking and other commercial activities, including hotel on the railway land at Shimla. It is argued that the Supervisory Committee has recommended the proposal for construction of multilevel parking which also has construction for commercial purposes/hotel. It is also stated that the project is necessitated by directions of the High Court and to promote public interest in controlling traffic congestion.

NGT refused to entertain the applications and said that the project was not permissible as per the directions of the NGT. "Even if a part of the project is held to be public utility, in that garb the main project is of commercial nature and goes upto three stories above the hill level," the NGT order, August 31, 2021 said.
