Order of the National Green Tribunal in the matter of Amit Sharma Vs Haryana Pond & Waste Water Management Authority & Others dated 11/10/2023.
The matter related to a pond in Dhaliawas, which used to be a primary source of drinking water for the village. The allegation of the applicant is that the water of the pond has become so contaminated that it cannot be used for any purpose. Human waste, household and sewage dumps, effluents and bio wastage is flowing into the pond and contaminating the water. Also, all drains and sewage of the village are released into the pond through the adjoining man-made sewage line and solid and bio waste is also directly being dumped into the pond. The pond has in fact become a dump yard, as a result of which, the nearby soil is being damaged and vegetation is adversely affected and the contaminated water of the pond is leading to health hazards.
The NGT directed a committee to be constituted of the Secretary, Haryana State Pollution Control Board and concerned Superintending Engineer, Irrigation Department, Haryana, representative of Ground Water Department and Sarpanch of the Gram Panchayat, Dhaliawas. The Committee will inspect the pond in question, get the water analysis report of the water of the pond and also ascertain the source of pollution in the pond and submit a report within two months before Chairperson, Haryana Pond & Waste Water Management Authority who will duly consider the report and ensure that the remedial measures are taken within three months of the receipt of the report.
