Order of the National Green Tribunal in the matter of Pritam Singh Vs Union Territory of J&K & Others dated 05/05/2020.
A factual and action taken report was sought from a joint Committee comprising Central Pollution Control Board (CPCB), Jammu & Kashmir State Pollution Control Board and District Magistrate, Ramban with reference to the allegation of illegal operation of stone crushers and hot mix plants operating in District Ramban in J&K, adversely affecting the ecology of the area. It was alleged that 26 stone crushers and hot mix plants were operated and dumping of residual matter directly into the river was coloring the water of the Chenab river which was affecting the aquatic life therein, in District Ramban, J&K, purely a hill district.
Accordingly, a report dated 05.02.2020 has been filed by the State PCB indicating illegalities in operation of some of the stone crushers and hot mix plants. However, the report is not complete as there is a proposal to reinspect the area in May – June after improvement of the weather conditions.
In view of above, the Committee has been directed to furnish a further comprehensive report in the matter. The concerned statutory authorities has also been asked to take remedial action against the illegalities by way of stopping the illegalities found and recovering compensation for the violations, following due process of law. The report has to be filed within three months.
