Order of the National Green Tribunal regarding pollution caused in the course of four lanning of National Highway from Udhampur to Banihal, Jammu and Kashmir, 26/04/2019
Order of the National Green Tribunal in the matter of Amresh Singh Vs Union of India & Others dated 26/04/2019 regarding pollution caused in the course of four-laning of National Highway from Udhampur to Banihal in Jammu and Kashmir by the Gammon India Limited and the Hindustan Construction Co. Ltd. These Review Applications have been filed by Gammon India Ltd. and Hindustan Construction Company Ltd. for review of the order dated 12.02.2019. By the said order, the Tribunal directed both the said applicants to pay interim compensation of Rs. 1 crore each and furnish a performance guarantee in the like amount with the Central Pollution Control Board (CPCB) pending determination of actual damages by the Committee constituted by the Tribunal.
The Tribunal disposed of the review applications and said that the orders were passed in the presence of counsel of both the parties. Further, the NGT directs an environment audit to be conducted by the Committee which would also undertake the exercise for assessment of damage, right from the beginning of the project and submit report within two months.
