Issue raised in the application was illegal mining by M/s Ultimate Group, tehsil Gannaur, district Sonipat, Haryana. It was further contended that the unit is extracting sand from Yamuna beyond permissible quantity and without consent to operate in violation of section 33 (A) of the Water (Prevention and Control of Pollution) Act, 1974 and in violation of EC conditions.

Judgement of the National Green Tribunal in the matter of The Malt Company (India) Pvt. Ltd. Vs Haryana State Pollution Control Board dated 19/04/2017 regarding directions passed by the Haryana State Pollution Control Board for the inclusion of malting industry into entry 19 of the red list (industrial sectors having Pollution Index score of 60 and above) drawn up for the purpose of regulating the consent to establish and consent to operate, granted by the Haryana State Pollution Control Board on 7th March, 2014.

Order of the National Green Tribunal (Principal Bench, New Delhi) in the matter of M/s. Mahabir Stone Crushing Co. Ltd. Vs. Haryana State Pollution Control Board & Ors. dated 03/07/2015 regarding pollution caused by stone crushing units, Mohabatabad Zone -II, Faridabad, Haryana.

The Tribunal also noted that there are saplings planted to create the requisite green belt which would act as a wind breaker and would also enrich the environment.
