Order of the National Green Tribunal in the matter of Tapan Kanti Bera Vs West Bengal Pollution Control Board & Others dated 04/09/2020.

The matter related to illegal operation of a brick kilns in village Khamarchak, district Purba Medinipur, West Bengal in violation of the directions of the Central Pollution Control Board (CPCB) dated June 27, 2017. All brick kilns were directed to convert to induced draft brick kiln (zig-zag brick setting). It was stated that the brick kiln had given a false impression that it had closed down, when actually it was not.

Order of the National Green Tribunal in the matter of Ranjan Sarkar & Others Vs State of West Bengal & Others dated 11/06/2020. The matter relates to environmental degradation of a doba (water body/lake) under Sarbasukha Mouza in the district of Paschim Medinipur that was being filled up illegally without having statutory clearances.

Order of the National Green Tribunal in the matter of Subhas Datta Vs State of West Bengal & Others dated 30/08/2019 regarding the proposed construction of a Medical College Hospital in Jhargram, West Midnapur District, West Bengal in a forest land measuring about 20 hectares. The land is stated to be a “Protected Forest” published in the Calcutta Gazette dated 21.06.1956 vide Notification No. 1855 dated 17.02.1956.

Order of the National Green Tribunal (Eastern Zone Bench, Kolkata) in the matter of Bhanu Dehuri Vs Director, Directorate of Mines Minerals & Others dated 05/09/2017 regarding illegal mining of sand in Jhargram and West Midnapur districts of West Bengal. The Tribunal while disposing of this Application directs the authorities to continue maintaining vigil to ensure that no illegal mining and lifting of sand takes place in the area.

Order of the National Green Tribunal (Eastern Zone Bench, Kolkata( in the matter of Tapan Das Vs Director, Directorate of Mines Minerals & Others dated 08/05/2017 regarding e-auction taking place in the district of Paschim Medinipur and Jhargram district in West Bengal. It is alleged that proper procedures are not being followed in accordance with West Bengal Minor Minerals (Concession) Rules, 2016 in respect of e-auction of sand mining at Kanshabati and Subarnarekha rivers. 

Order of the National Green Tribunal in the matter of Sona Bricks Maker Vs Joydeep Mukherjee & Others dated 02/03/2017 regarding brick kilns in Purba Medinipur (West Bengal) functioning without consent to operate. NGT directs the brick kilns to be closed until the consents to operate are granted by the State PCB.

Order of the National Green Tribunal (Eastern Zone Bench, Kolkata) in the matter of Bengal Trading Company Vs West Bengal Pollution Control Board & Others dated 02/03/2016 regarding brick kilns operating in Purba Medinipore, West Bengal.

NGT in the Order said that since in the case of new brick kilns a mandatory condition for establishing multi-layered green belt is imposed, it would also be applicable to the brick kilns existed prior to or after the year 2000.
