Order of the National Green Tribunal regarding construction being carried without environment clearance, Tamil Nadu, 06/08/2018
Order of the National Green Tribunal in the matter of Arjunan Muthukrishnan Vs. The State Environment Impact Assessment Authority & Others dated 06/08/2018. This application seeks direction for action against M/s. Jain Housing for violation of the EIA Notification, 2006, the Environment (Protection) Act, 1986, the Water (Prevention and Control of Pollution) Act, 1974, and the Air (Prevention and Control of Pollution) Act, 1981. The Applicant has stated that construction has been carried out without environmental clearance and located Sewage Treatment Plant (STP) near applicant’s flat without any consent under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981. The STP is causing serious pollution. The construction has impact on hydrology and drainage pattern. There has been no impact assessment. Clearance was for 412 units, but 1016 flats have been constructed.
NGT directs Tamil Nadu Pollution Control Board (TNPCB) to look into the matter and, after ascertaining the facts from the State Level Environmental Impact Assessment Authority and the Chennai Metropolitan Development Authority, take such action as may be called for under the law.
