Order of the National Green Tribunal in the matter of Society for Protection of Environment & Biodiversity & Others Vs. Union of India & Others dated 03/05/2017 regarding exemption of construction projects from the process of environment impact assessment (EIA) and prior environmental clearance. The Applicant wants MoEF not to grant any concurrence to any bye laws of any state exempting prior environmental clearance till the pendency of this Application.

The Court is of the view that in case any proposal of the States are processed and approval is granted, it shall be communicated to the State concerned that it is subject to decision in the Court (Original Application 677/2016). Also in the event of any proposal that has been processed and draft approval is granted by the MoEF, even those States will also be conveyed about this fact that the proposals are subject to outcome of this Application.
