Order of the National Green Tribunal in the matter of Satyanand Ray Vs State of Bihar & Others dated 27/03/2025.

The applicant said that Nagar Parishad Danapur Nizamat, is dumping garbage adjacent to the applicant's house in an open air by creating a boundary though the area which is a residential area and there are other persons also residing in the said area. The applicant has alleged the improper disposal of garbage resulting in pollution in the Danapur area adversely affecting the health and environmental quality of the area. Photographs have been filed which show a dismal and despicable condition of the area due to slack and improper garbage management and municipal waste disposal.

The NGT directed notice to be issued to state of Bihar; Bihar Urban Development and Housing Department; District Magistrate, Patna; Nagar Parishad Danapur Nizamat and Bihar State Pollution Control Board. NGT directed the Bihar State Pollution Control Board to inspect the site and submit its report especially with regard to siting criteria, standard of municipal waste disposal and the present condition of the area. All the respondents have been asked to file their counter affidavits. The case will be next heard on July 2, 2025.
