Order of the National Green Tribunal regarding illegal discharge of untreated effluents by Nityanand Institute of Medical Science, Pune, Maharashtra, 04/07/2019
Order of the National Green Tribunal in the matter of Zumbarlal Dnyanoba Murkute Vs Dr. Nitin Virsingh Daliya & Others dated 04/07/2019 regarding illegal discharge of untreated effluents by Nityanand Institute of Medical Science while running a hospital, resort and party hall. It has been alleged that there is no proper waste management arrangement and untreated effluent was continuously being discharged causing massive damage to the environment. The report submitted by Maharashtra Pollution Control Board (MPCB) reveals environmental non-compliances. The Institute had not obtained authorisation under the provisions of Bio-Medical Waste Management Rules, 2016 and there was no adequate sewage treatment plan for treatment of domestic effluent generated from the Institute.
The NGT said that "non-compliance of the environment norms by the Institute has undenyingly caused serious damage to the environment due to the unscientific manner in which the Institute was being run as reflected in the report. The Institute cannot but remedy the defects but apart from that they also cannot be absolved from the damage that they have caused to the environment."
MPCB has been directed to assess the damage caused to the environment in accordance with the guidelines prescribed by the CPCB within a period of one month and recover the same from the Institute. While recovering the damages so assessed, the Board shall also ensure that appropriate steps and measures are taken for remediation and restoration of the environment the cost of which shall also be assessed and recovered from the Institute.
