Order of the National Green Tribunal regarding illegal marble mining at Saren Phala and Nichla Phala at Udaipur, Rajasthan, 21/02/2019
Order of the National Green Tribunal in the matter of Residents of Gram Panchayat Varahiya Vs State of Rajasthan dated 21/02/2019 regarding illegal marble mining at Saren Phala and Nichla Phala at Udaipur, Rajasthan. A report was sought from the Rajasthan State Pollution Control Board (RSPCB) and the District Magistrate, Udaipur, Rajasthan. The report shows mining waste was dumped near the bank of Som river by M/s Vineet Udhyog Limited, M/s Evergreen Marble & Granites and Sanjeev Modi.
The Tribunal says that it is clear that illegal activity was going on and though notice for closure is said to have been issued, doing so is not enough compliance of duties by the SPCB or other regulatory bodies. NGT directs the RSPCB and the District Magistrate, Udaipur, Rajasthan to jointly assess the quantum of environment compensation to be recovered from the persons responsible for illegal mining within one month and vehicles found to be involved in illegal mining be seized.
