Order of the National Green Tribunal regarding regulation of use of charcoal as raw material, 14/03/2019
Order of the National Green Tribunal in the matter of Indian Institute of Sustainable Development Vs Union of India & Others dated 14/03/2019. The issue for consideration is the regulation of use of charcoal as raw material for the industry to avoid cutting of trees. The matter was decided by the Tribunal on 09.10.2017. The present proceedings are for execution of the said order.
History of the Case:
- On 13.08.2018, it was found that Ministry of Environment, Forests and Climate Change (MoEF&CC) has issued an advisory but had not amended the Notification on the subject containing the guidelines called “The Wood-Based Industries (Establishment and Regulation) Guidelines, 2016”.
- Vide order dated 17.01.2019, last opportunity was given requiring the MoEF&CC to comply with the direction in the order dated 13.08.2018.
- An affidavit dated 08.03.2019 has been filed annexing the Notification dated 22.02.2019 amending “The Wood-Based Industries (Establishment and Regulation) Guidelines, 2016” by inserting Para 2 (i) (h) and Para 8(iii). The effect of the amendment is that wood based industries, which include charcoal, are regulated, as per the said guidelines.

In View of the MoEF compliance, NGT disposes of the application.
