Order of the National Green Tribunal in the matter of Veterans Forum for Transparency in Public Life Vs Chapra Nagar Nigam, Chapra & Others dated 08/03/2021. The issue for consideration was restoration of Khanua Nala at Chapra, district Saran, Bihar.
A report filed by the Secretary, Urban Development August 17, 2019 showed that funds had been sanctioned and steps initiated - the action taken report furnished by the Municipal Commissioner provided for the cleaning, waste management, removal of encroachment and development work of Khanua nala. However the applicant has said that environmental norms were still being violated.
The NGT directed the Secretary, Urban Development to ensure further action by continuous monitoring to uphold the rule of law and for protection of environment and public health. The court said that it must be ensured that the flow of drain was not obstructed by the reduction in the width and by the encroachments. The Nagar Nigam, Chapra and the District Magistrate, Saran should take action on the ground and comply with directions of the Secretary, Urban Development on the subject. The Chief Secretary, Bihar has been asked to monitor the situation at least once in six months till the situation improves.
