Order of the National Green Tribunal regarding sewage pollution in NOIDA, Uttar Pradesh, 06/11/2020
Order of the National Green Tribunal in the matter of Abhisht Kusum Gupta Vs State of Uttar Pradesh & Others dated 06/11/2020. The issue for consideration is the remedial action for preventing untreated sewage going to the “irrigation canal” in Sector 137, NOIDA ((New Okhla Industrial Development Authority), Uttar Pradesh.
One of the major reasons for discharge of untreated sewage is deficient sewage treatment plants (STP) in 95 high rise buildings in Noida, apart from such discharge at some other locations.
Counsel for NOIDA stated that only 57 societies have been inspected out of 95 and the remaining societies are to be inspected. Wherever deficiencies have been found, action has been initiated. Counsel for the Delhi Jal Board (DJB) stated that action has been taken on its part. However, there was no response from the East Delhi Municipal Corporation (EDMC) and the Secretary Urban Development, Uttar Pradesh in respect of action at Khoda Nagar Parishad, Makanpur.
Counsel for EDMC says that there is a proposal to shift the dairies but that is not possible in absence of land. The NGT expressed its dissatisfaction at the stand of the EDMC.
The NGT categorically said that the rule of law must be enforced to prevent pollution and "activities operating in violation must be forthwith stopped and compensation recovered for the violations".
The bench of Justices Adarsh Kumar Goel and Sheo Kumar Singh directed that action against "erring high-rise buildings in Noida" must be taken expeditiously and compensation assessed by a joint Committee of CPCB, Uttar Pradesh Pollution Control Board, NOIDA and District Magistrate, NOIDA within three months.
