Order of the National Green Tribunal regarding Environmental Clearance for construction of buildings with built up area of 20,000 Sq. meter and above, Patna, Bihar, 16/09/2016
Order of the National Green Tribunal (Eastern Zone Bench, Kolkata) in the matter of Sanjay Sinha Vs State of Bihar & Others dated 16/09/2016 regarding Environmental Clearance for construction of buildings with built up area of 20,000 Sq. meter and above within the territorial jurisdiction of those ULBs (Urban Local Bodies), Patna, Bihar.
The Tribunal finds the constitution of the Patna Metropolitan Planning Committee curious as they find that most of the members "are such that their expertise on the subject appear to be grossly questionable." NGT in its Order further questions how such a body can approve a vital document like Master Plan for the city of Patna which is not only the capital of the State of Bihar but also one of the premier cities of the country. NGT directs the Govt. of Bihar to review the notification and appoint persons of eminence having knowledge in the field as members of such premier committee and said that "the committee should not be made a repository for rehabilitation of political elements."
